I am married, doesn’t my spouse automatically inherit all my property and assets without Probate?
No, without a proper estate plan, your assets will go to Probate and your spouse will only receive a portion of your estate. Your spouse may be required to share the majority of her possible inheritance with your children, siblings, and even your parents; not to mention the IRS and creditors.
Will my adult children’s doctor allow me to participate in decisions if they are still on my health insurance?
No. Your health insurance may cover your children until age 26, but at age 18 doctors will not disclose any medical information to you about your children, nor allow you to participate in any medical decisions without a health care power of attorney and HIPAA release form.
Is the inheritance I give my children in my last will protected from creditors and divorce?
No, the inheritance you leave your children in a will receives no special protection from their creditors or if they divorce. It can all be lost. Only a living trust can provide creditor and divorce protection for your children and grandchildren.
Is it true that leaving someone an inheritance the wrong way can actually be bad for them?
Yes, in some cases it can be harmful. Children with special needs, college age children, and the elderly can be harmed by an inheritance. They can lose disability benefits, college scholarships, or Medicaid. A sudden financial windfall can trigger a divorce, or cause relapses for alcoholics, and for gambling and drug addicts.
